Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Precision Hope ("Precision Hope," "we," "us") governing your use of the Precision Hope website and application (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. What Precision Hope Is — and Is Not

Precision Hope is an informational and educational tool. It is NOT medical advice, diagnosis, or treatment, and it is not a substitute for professional medical care. Your licensed clinician evaluates your situation and decides on care. Precision Hope helps you understand information and prepare better conversations with that clinician.

Nothing in the Service or in any AI-generated output is a medical recommendation or creates a doctor-patient relationship. Always seek the advice of a qualified health provider with any questions about a medical condition, and never disregard or delay professional advice because of something you read here.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Accounts are intended for parents, guardians, and adult caregivers managing medical information on behalf of a patient. You are responsible for the information you enter, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptance and Changes to These Terms

By creating an account or using any part of the Service, you accept these Terms. We may update them from time to time; the "Last updated" date will change and, where appropriate, we may ask you to review and re-accept. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the Service and you may delete your account.

4. AI Output May Be Incomplete or Wrong

The Service uses artificial intelligence (including third-party AI — see Section 8) to read lab results, explain findings, generate questions, and answer your messages. AI can make mistakes, miss context, or produce incomplete or inaccurate results. AI output is a starting point for a conversation with your clinician, not a final answer. Do not act on it without reviewing it with your care team.

Our handling of your information is described in our Privacy Policy, which is part of these Terms. In short: your family's data is private to your account; you can delete your account and all associated data at any time; and any sharing of de-identified data to help other families is strictly optional, off by default, and requires your opt-in.

8. Third-Party Services

The Service relies on trusted third-party AI providers to perform AI processing. When you use AI features, relevant content is sent to those providers and handled under their terms and privacy policies. We are not responsible for the practices of third-party providers, and your use of AI features is also subject to their terms. See the Privacy Policy for details.

9. Optional Contribution of De-Identified Data

You may choose to contribute your child's de-identified data to help other families. This is entirely optional, turned off unless you opt in, and you may withdraw at any time. Only anonymous, aggregate insights are ever made available to others, and never any information that identifies you or your child. Full details are in Section 5 of the Privacy Policy.

10. Intellectual Property

The Service, including its software, design, text, and branding (such as the Precision Hope name and the BEN Promise), is owned by Precision Hope and protected by applicable law. You retain ownership of the content you upload and enter; you grant us a limited license to process and store that content solely to provide the Service to you. We grant you a personal, non-transferable, revocable license to use the Service under these Terms.

11. No Warranty — "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, secure, or that any particular result will be achieved.

12. Limitation of Liability

To the fullest extent permitted by law, Precision Hope and its founders, operators, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service — including any reliance on AI-generated information or any decision made based on the Service. To the extent any liability is not excluded, our total aggregate liability for any claim shall not exceed the greater of the amount you paid us in the twelve months before the claim (which, during any free period, is zero) or US $100.

13. Indemnification

You agree to indemnify and hold harmless Precision Hope and its operators and contributors from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Termination and Deletion

You may stop using the Service and delete your account and all associated data at any time through the in-app settings. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

15. Service Changes and Availability

Precision Hope is an early-stage project. We may add, change, or remove features, and may pause or discontinue the Service at any time. We will try to give reasonable notice of significant changes when we can.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where applicable law gives you the right to your local courts. Before filing any claim, you agree to contact us first at [email protected] so we can try to resolve it informally.

17. General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Precision Hope regarding the Service.
